Let’s get one thing straight, if you are legally married to another person, then you stay that way regardless of separation. You cannot get married until you are legally divorced from your current spouse. You can still loose a larger portion of the community estate due to adultry. There is no legal separation in Texas. I am sure that you and your spouse no longer wish to be together but you must go through the proper channels to have the marriage dissolved.
Just recently, I had a opposing parties client inform me that during this divorce proceeding she did not think she was still married to her spouse because her spouse told her they could see other people. It is still adultry.
