Discovery and its abundance of confusion?

What is discovery?  Discovery is a tool used in most cases to find out information relating your case or the case the other side has against you. 

 

In a divorce case, you want to discover bank accounts, property, real estate, stocks and bonds, calendars for child custody, pay scales, and much much more.  Why is it needed?  It is needed to help establish a fair and equitable division of the martial estate.

 

When I propound discovery on the opposing side, generally I sent Request for Production of documents, Interrogatories, Request for Disclosure, and rarely, Request for Admissions.  The reason is to see what the opposing side has in their hands.  Additional, my client may be unaware of the financials in the marital relationship.  There may be an issue of abuse on one side or both.  These are strictly tools to find information in preparation of trial.
